There are certain documents that are required to be served on a tenant prior to the start of a tenancy to ensure you are legally compliant and don’t run the risk of jeopardising any future repossession claims. Any notices served on the tenant need to be done so in the correct format and any procedural inaccuracies can render them invalid. This is why it’s important to get it right first time and employ the services of a solicitor if necessary.
Do you find it frustrating when your tenant doesn’t engage in the deposit repayment process? Maybe they have absconded from the property or have left the property in a mess with possible rent arrears, leaving you to pick up the pieces. You may have to claim the tenant’s full deposit but if the tenant has no incentive to respond - as they have to as per deposit scheme rules – it leaves you with a problem. If this is the case you would need to go down the legal route of having the deposit released back to you, which would involve employing the services of a solicitor, magistrate, or commissioner for oaths. We partner with Mosshaselhurst Solicitors in Northwich to facilitate this process as part of our fully managed package.
