Help - Tenant's done a runner!

A Landlord managing a let only property approached me for advice.  One of his Tenants had failed to pay rent and was three months in arrears.  The Tenant was refusing to respond to all contact from the Landlord and the Landlord suspected she had moved out.  We also suspected that the Tenant had vacated and it appeared had secured an Assured Short-hold Tenancy contract with another agent for another property.

 The Belvoir legal team advised that there were 2 issues. Firstly the Landlord or solicitor needs to issue a Section 8 notice seeking an Order for possession of the property, Tenancy arrears and Court fees.  The second is not of concern to the Landlord, but a Tenant cannot have an AST on two properties; that issue rests with the new Agent.

 With the agreement of the Landlord, Belvoir proceeded with a Section 8 notice, which we issued to both properties.  The case is on-going.  This issue highlights the importance of getting the right Tenant through diligent referencing.  This is true for both Agents involved here.
